Divorce and Child Custody Across Borders

Divorce between Zimbabweans where one spouse is in the UK and the other in Zimbabwe is complicated. Generally, you should divorce in the country where you are habitually resident — meaning if you live in the UK, UK courts have jurisdiction. However, if property in Zimbabwe is involved, a Zimbabwean court order may also be needed to deal with that specific asset. A UK divorce decree can be recognised in Zimbabwe through the courts but the process is not automatic. Child custody: if both parents have parental responsibility and one parent takes the child to Zimbabwe (or vice versa) without the other's consent, this could constitute child abduction under the Hague Convention — HOWEVER, Zimbabwe is NOT a signatory to the 1980 Hague Convention on child abduction, which makes recovery extremely difficult. If you fear a child may be taken to Zimbabwe: apply for a Prohibited Steps Order in the UK courts urgently. For maintenance/child support: UK court orders are not directly enforceable in Zimbabwe and vice versa — separate proceedings may be needed in each jurisdiction.
