Power of Attorney for Zimbabwe from the UK: How to Grant, Notarise and Use a POA Remotely

For Zimbabweans living in the UK who need to manage property, run a business, handle an estate, or deal with legal matters back home, a Power of Attorney (POA) is one of the most practical legal tools available. It allows you to formally authorise a trusted person in Zimbabwe to act on your behalf — signing contracts, selling land, opening bank accounts, or representing you in legal proceedings — without you needing to fly back. ## What Is a Power of Attorney Under Zimbabwean Law? A Power of Attorney is a legally binding document in which one person (the principal or grantor) nominates another person (the agent or attorney) to conclude certain transactions on their behalf. In Zimbabwe, POAs are governed by common law principles rooted in Roman-Dutch law. For property matters specifically, the Deeds Registries Act [Chapter 20:05] applies. There are two main types: **General Power of Attorney (GPOA):** Grants broad authority to the agent — managing assets and property, operating bank accounts, collecting debts, signing contracts, handling tax matters with ZIMRA, and managing financial affairs generally. **Special Power of Attorney (SPOA):** Limited to a specific transaction or purpose. This is the type required for property sales, litigation, and any matter requiring precise, defined authority. Importantly, you cannot use a general POA to institute or defend court proceedings in Zimbabwe — a Special POA is required for litigation, as it carries legal costs and consequences that demand explicit authorisation. Note that Zimbabwe does not recognise the concept of a Lasting Power of Attorney (LPA) or Enduring Power of Attorney (EPA) — the type used in England to cover future mental incapacity. A standard Zimbabwean POA does not automatically continue if the grantor loses mental capacity. ## The UK-Specific Process: Notarisation and Authentication This is where the process differs meaningfully from someone signing within Zimbabwe. A POA signed inside Zimbabwe only needs to be witnessed by a Justice of the Peace or Commissioner of Oaths. But a POA signed abroad — including in the UK — must be attested by a **Notary Public** who affixes their notarial seal. A simple signature witnessed by a friend, solicitor, or GP does not meet the Zimbabwean legal standard. The full process from the UK typically runs as follows: **Step 1 — Draft the POA.** Either instruct a Zimbabwean lawyer to draft the document and send it to you unsigned, or use a reputable document service. The document must include: full names and passport numbers of both principal and agent; a clear and specific statement of the powers being granted; the effective date; any limitations; a revocation clause; and (for property matters) specific details such as stand number and title deed reference. **Step 2 — Notarise in the UK.** Take the unsigned document to a UK Notary Public — not a solicitor, not a commissioner of oaths — along with your valid passport and proof of address. The Notary Public will verify your identity, witness your signature, and apply their official notarial seal. UK Notary Public fees for this service typically range from £50 to £150 depending on the firm and complexity. **Step 3 — Apostille (if required).** The UK is a signatory to the Hague Convention, which means documents notarised by a UK Notary Public can be apostilled by the Foreign, Commonwealth & Development Office (FCDO). An apostille certifies the authenticity of the notary's signature for use in other Hague Convention countries. Zimbabwe is also a Hague Convention signatory, so an apostille is the standard route to legalise your notarised POA for use there. The FCDO apostille service costs £30 per document (as of 2024) and can be arranged via post or through a legalisation agent. **Step 4 — Send the original to Zimbabwe.** Zimbabwean authorities and institutions generally require the original notarised document, not a scan or copy. Use a tracked courier such as DHL. Courier costs from the UK to Zimbabwe typically run £40–£80. ## Property Transactions: Additional Requirements If the POA is being used to buy, sell, or transfer immovable property (land or a house) in Zimbabwe, additional formalities apply. The document must be executed before a Notary Public (this is already covered if signed in the UK before a notary), and it must be registered with the Deeds Registry in Zimbabwe. The POA must specifically identify the property — stand number, title deed reference — and cannot be a vague general authorisation. The scope should be tailored to what you actually need — avoid granting wider powers than necessary. ## Revoking a POA A POA can be revoked at any time by the grantor, provided they have legal capacity. Revocation should be done in writing and communicated formally to the agent and any third parties who may be relying on the document. If you have registered a POA with the Deeds Registry, revocation should also be registered. ## Practical Tips for UK-Based Zimbabweans - Always instruct the Zimbabwean lawyer handling your matter to draft the POA, not just any generic template.
