Indefinite Leave to Remain (ILR) is the gateway to permanent residency in the UK — and for many Zimbabweans, it represents one of the most significant milestones in their immigration journey. Once granted, ILR removes the time restrictions on how long you can stay in the UK, opens access to public funds, and places you one step away from British citizenship.
**What ILR Means in Practice**
ILR holders are not subject to immigration control. You can work for any employer, access NHS treatment on the same basis as British citizens, claim most welfare benefits, and apply for a British passport after a further qualifying period (typically 12 months of holding ILR as a Settled Person). ILR also allows you to travel freely and return to the UK without needing a visa, though extended absences of more than two years can cause ILR to lapse.
**Eligibility Routes for Zimbabweans**
The route to ILR depends on how you entered and have remained in the UK. The most common routes for Zimbabweans include:
- **Skilled Worker (formerly Tier 2)**: After five continuous years in the UK on a Skilled Worker visa, you become eligible to apply for ILR. Your employer must have sponsored you throughout, and you must meet a minimum salary threshold — currently £26,200 per year or the going rate for your occupation, whichever is higher. This threshold has risen sharply since April 2024.
- **Family Visa (Spouse/Partner)**: Those who entered as a spouse or partner of a British citizen or settled person typically qualify after five years, subject to meeting the relationship genuineness and financial requirements throughout.
- **Long Residence**: If you have lived continuously and lawfully in the UK for ten years, you may qualify under the Long Residence route. This is relevant for Zimbabweans who have held multiple visa categories over the years.
- **UK Ancestry Visa**: Commonwealth citizens — including Zimbabweans — with a grandparent born in the UK can apply for ILR after five years on an Ancestry visa.
- **Refugee and Humanitarian Protection**: Those granted refugee status or humanitarian protection can apply for ILR after five years, though the rules changed in 2023 and new grants of refugee status now receive a shorter initial leave period before ILR becomes available.
**The Application Process**
Most ILR applications are submitted online via the UK Visas and Immigration (UKVI) portal. The current fee for most ILR applications is £2,885 per person (as of 2024), which is a substantial cost for families applying together. There is no healthcare surcharge to pay on top for ILR applications.
Applicants must book a biometric appointment at a UK Visa and Citizenship Application Services (UKVCAS) centre to provide fingerprints and a photograph. Premium same-day or enhanced service appointments are available at additional cost and can be worthwhile given the processing anxiety involved.
The Life in the UK Test is a mandatory requirement for most ILR routes. The test costs £50, consists of 24 questions drawn from the official handbook, and must be passed with a score of 75% or above. Most applicants find dedicated preparation using the official study materials sufficient. An English language requirement also applies — typically demonstrated through a recognised qualification or by holding a degree taught in English.
**Common Pitfalls**
Several issues regularly cause ILR applications to be refused or delayed for Zimbabwean applicants:
- **Absences from the UK**: Most routes require no more than 180 days outside the UK in any 12-month period during the qualifying period. Even a single trip home for a funeral or family emergency can exceed this if not carefully tracked. Keep a precise record of every departure and return.
- **Gaps in leave**: Any period where your visa expired before a renewal was granted — even briefly — can break continuity. Section 3C leave (the legal extension while a renewal is pending) does count toward continuous residence, but must be applied for before the original visa expires.
- **Salary threshold changes**: Skilled Worker applicants must meet the salary threshold at the time of ILR application, not just when their visa was granted. Pay rises required by UKVI guidance since April 2024 have caught some employers and employees off guard.
- **Criminal record issues**: Any criminal conviction, including minor ones, must be declared. Certain offences will automatically disqualify an applicant. Seek legal advice if there is any doubt.
- **Incorrect supporting documents**: Missing payslips, incomplete bank statements, or photocopies instead of originals have caused unnecessary refusals. Follow the UKVI checklist meticulously.
