Upper Tribunal Limits Scope for Immigration Judicial Reviews in Scotland

In R (EB) v Secretary of State for the Home Department (Scotland; Transfer of claims) [2025] UKUT 412 (IAC), the Upper Tribunal held that immigration judicial reviews should only be transferred from Scotland's Court of Session in rare cases. The tribunal ruled that transfers are appropriate only where the specific issues raised would genuinely benefit from the Upper Tribunal's specialist immigration expertise. The decision effectively limits the volume of Scottish immigration JRs that can be redirected to the Upper Tribunal.
