Vulnerable Witness Guidance: Not Following It Not Always a Legal Error

The UK Upper Tribunal has clarified that failure to follow the Joint Presidential Guidance Note No 2 of 2010 on vulnerable witnesses does not automatically constitute an error of law. The guidance sets out steps tribunals must take to ensure fairness for child, vulnerable adult, and sensitive appellants in immigration and asylum proceedings. Tribunals retain discretion, and non-compliance must be shown to have caused actual unfairness to amount to a legal error.
